Joint Employer is built around a model with a documented history of disclosure, regulatory engagement and review. That history is a material part of the proposition: the model was not designed in isolation and then simply marketed as compliant.
HMRC disclosure and VAT review
The model was developed with detailed disclosure to HMRC. Published HMRC correspondence dated 21 November 2018 states that, if the working arrangement follows the contracts provided, HMRC would consider a legitimate joint employment to exist for the purposes reviewed.
Further government review
Company records describe a further two-year period of scrutiny and engagement involving HMRC, BEIS / the Employment Agency Standards Inspectorate and other public-sector stakeholders.
BEIS position on recruitment law
A company-published guide reproduces BEIS correspondence stating that, on the evidence reviewed, the joint employment arrangement was not contrary to the Employment Agencies Act 1973 and that the Conduct Regulations did not prevent joint employment or a KID offering joint employment.
Fair Work Agency guidance
The Fair Work Agency now publishes specific guidance on joint employment models in the recruitment sector, recognising that a joint employment model can operate within the recruitment-law framework when the actual responsibilities and arrangements support it.
